May. 8th, 2010 01:22 amThere is a bill in congress that would give the state department the power to excommunicate American citizens without a trial, and naturally the purpose of doing this would be to permit the state to torture and imprison and otherwise violate the constitutional rights of a citizen with the smoke screen of the fact that they are no longer a citizen and hence have no rights under the constitution. If this passes I would hope the courts would strike down the bill for no other reason than that it makes huge inroads on their territory. I also hope that in the next few years the court will clarify, if only to educate the public, that things like torture and imprisonment and the provisions of the fourth amendment are not just there to protect citizens. The constitution limits government power, any time it outlines rights the government is not to touch there is no language insinuating that these are rights of citizens, they are prohibitions on government action, and not limited to its own citizens.
